Real Estate: Commercial & Residential

At Roberts Law, we assist with both commercial and residential real estate matters, including the negotiation, purchase and sale of real property. The firm works closely with owners, buyers and sellers to counsel on a variety of real property matters including deeds, financing, acquisitions, dispositions, due diligence, title claims, joint ventures, leasing, construction, development, liens, property management and more.

Representative clients include first-time home buyers, real estate developers, commercial landlords and tenants, individual property owners with access or boundary issues, banks and other financial institutions, small business owners, title insurance companies, and every type of client in between.

Commercial Properties

At Roberts Law, we represent developers, investors, and owners on acquisitions and dispositions of all types of commercial properties located throughout Idaho. We also draft and review commercial leases, and advise clients seeking to acquire or vacate properties. Representative transactions include retail properties, office buildings, hotels, warehouses, apartment complexes and vacant land that has the potential for development for these types of buildings.

Whether you are purchasing, selling or leasing, we bring years of experience to bear in negotiating fair and favorable outcomes for our clients. We want to make sure our clients maximize their lease, purchase, and/or sale through creative, practical and cost effective methods.

Residential Properties

Buying or selling a home can be the single largest personal business transaction in which a residential client will ever partake. At Roberts Law, we can help guide you through this increasingly complex process. We represent buyers and sellers of high-end single family homes, co-ops, condominiums and townhouses. We distinguish this practice by offering aggressive representation and highly personal service. As seller’s counsel we look to cover all those loopholes and contingencies which create uncertainty and sometimes disappointment. As purchaser’s counsel, we seek to maximize seller disclosures and representations and work hard to assure that our client gets all that has been bargained for with no unpleasant surprises.

Whether you are purchasing your first home, upgrading to a larger home, or selling your “empty nest”, it should be an exciting and rewarding experience. For those seeking experienced residential real estate advice, Roberts Law can help you take the mystery out of buying real estate and make certain that you have enough information to make informed decisions about your purchase or sale.

The Function of a Real Estate Attorney

One of the most important decisions you will make in the buying process is the attorney that you choose to represent you in the purchase of your home. While your real estate salesperson or broker will work with you to make a decision on which home may satisfy your particular needs, your attorney is the only party who will be working solely for your benefit during the buying process.

In representing a prospective purchaser/seller, an attorney performs the following functions:

  • Reviews and negotiates the Contract of Sale
  • Oversees the process of your purchase, i.e., complying with the terms and conditions of the contract;
  • Reviews the Abstract of Title; and
  • Coordinates the closing of title among all parties and the mortgage loan with your lender.

Litigation and Dispute Resolution

Lurking in the background of every real estate transaction is the very real possibility that a dispute will arise. At Roberts Law, we bring a strong background in Litigation and Dispute Resolution to every matter and work diligently to ensure that disputes do not arise and to aggressively protect your interests if they do.
